Did Microsoft Make Google Pay Triple Rate To Mozilla?

Many took this as charity, and for the purpose of advancing the web.

I don't think that's accurate. What would be more accurate is that many media outlets have misrepresented various Googler's comments that what Google pays Mozilla advances Google's interest in the open web, and that that is one reason why Google would continue to funnel lots of money to Mozilla even though it has its own browser which competes directly with Firefox as a claim about "charity".

That claim has nothing to do with charity, its a statement that is about revenue -- largely ad revenue, but also revenue from Google's other services -- because the more happy people are with doing things on the web (whether new things or things they previously would use desktop apps or non-web technologies for) the bigger the market is for online advertising, web application hosting, and all kinds of other services Google provides for a price. And the more the web uses open standards to do that, the more Google's various services that rely on scraping, analyzing, and summarizing data from across the web can do.

There's also, of course, the direct search ad revenue that Google derives from use of their products in search, which is the most direct and visible reason they would pay Mozilla to be the default Firefox search provider. And of course that's important, too. But their strategic interest in making the web friendlier to promote their whole host of services (which is still mostly advertising, but not all of that advertising is search advertising) is why they are consistently willing to pay more to be the default search provider in Firefox than Microsoft, for whom promoting the open web isn't a strategic interest in the way it is for Google. Because Google sees a return beside the direct search revenue that Microsoft doesn't, because Google's long-term business interest are more closely aligned with Mozilla's ideological interests.

DA: No charges against son of OJ Simpson relative (AP)

SANTA ANA, Calif. ? Prosecutors have decided not to file charges against the 25-year-old son of Denise Brown and his girlfriend after they were arrested in a reported domestic violence incident.

Brown became an advocate against domestic violence after her sister, Nicole Brown Simpson, was slain in 1994.

Sean Brown and his girlfriend, 22-year-old Amy Johnson, were arrested after police answered a pre-dawn call Tuesday and found the couple with superficial wounds that didn't require hospitalization.

They were held in jail for investigation of inflicting injury on a spouse, but they were released when the district attorney decided not to file charges.

O.J. Simpson was acquitted of murder in a high-profile trial where Denise Brown testified that he had physically abused his ex-wife. She founded the Nicole Brown Simpson Foundation to fight domestic violence.

Planned Spy Campus Divides Bethesda Community

BETHESDA, MD (WUSA) --- Residents of wealthy neighborhoods with spectacular views of the C and O Canal and the Potomac River here are divided over plans by the government to build what it is calling an intelligence community campus on the 40 acre site of the old National Geospatial Intelligence Agency just off MacArthur Blvd. The campus would provide office space to about three thousand employees of various intelligence agencies

The National Geospatial Intelligence Agency, known as the government mapping agency, has moved its headquarters to Ft. Belvoir in Virginia, taking business away from shops in Bethesda.

"We've seen a drop in business because the defense mapping agency, they've slowly taken their employees away...We have been thinking the last couple of years, how is this going to impact our business?" said Amy Schmonsees, owner of the Wild Bird Center in a nearby shopping mall.

"We were excited to hear about three thousand jobs coming in. The quicker the better," she said.

But some neighbors are worried what the change will mean to their quality of life, and worry about the environmental impact of the adjacent and sensitive C and O Canal National Historic Park.


"There are significant environmental issues about clearing several acres of trees (that) will effect the the watershed and the national park area," said neighbor Laird Patterson.

Some neighbors are particularly worried about a proposed six story parking garage that would require the destruction of trees and would change the vistas both from and of the Potomac River.

"We, of course, don't want all the trees taken down. We live in the neighborhood. We want them to be respectful of that, for sure," said Schmonsees of the Wild Bird Center.

There are other issues as well.

"I think there are multiple impacts. The first is that there are tremendous traffic issues because they are proposing a 44 percent increase, at least, in the traffic," said Patterson in a 9News Now interview on Monday evening.

A planning review is scheduled for February.

Appeals court to review BofA $8.5 billion MBS pact (Reuters)

(Reuters) ? A U.S. appeals court agreed to resolve a dispute among institutional investors over whether Bank of America Corp's $8.5 billion mortgage debt settlement should be sent back to a New York state court for approval.

The 2nd U.S. Circuit Court of Appeals in New York on Tuesday said it plans to rule within a 60-day period on whether U.S. District Judge William Pauley in Manhattan correctly took the case from the state court.

It granted the requests of Bank of New York Mellon Corp, which as trustee negotiated the settlement, and investors including BlackRock Inc, MetLife Inc and Allianz SE's Pimco to appeal Pauley's decision.

Other investors, led by a group called Walnut Place, preferred that the case stay in federal court, which could result in higher recoveries.

The June settlement was intended to address much of Bank of America's remaining legal liability from the Charlotte, North Carolina-based bank's 2008 purchase of mortgage lender Countrywide Financial Corp.

It would cover claims by investors in 530 mortgage securitization trusts with $174 billion of unpaid principal that the home loans underlying their investments were toxic or underwritten poorly.

Bank of New York Mellon had negotiated the accord with 22 institutional investors, and sought approval by New York State Supreme Court Justice Barbara Kapnick in Manhattan.

But Walnut Place and other investors that were not part of the talks, but would be bound by the outcome, complained that the $8.5 billion payout was too low.

Moving the case to federal court could make it easier for these investors to back out, or negotiate higher payouts.

In a two-page order, the 2nd Circuit asked the parties to address several issues, including whether the settlement was a "mass action" allowing federal court review.

"We have jurisdiction to determine our jurisdiction," the 2nd Circuit said.

Pauley had on October 19 said the case implicated "paramount federal interests" such as the integrity of nationally chartered banks and the vitality of financial markets.

Bank of America spokesman Lawrence Grayson declined to comment. Bank of New York Mellon spokesman Kevin Heine and David Grais, a lawyer for Walnut Place, did not immediately return calls.

The 2nd Circuit also granted Bank of America's request to file papers supporting requests for an appeal.

The cases are Bank of New York Mellon v. Walnut Place LLC et al, 2nd U.S. Circuit Court of Appeals, Nos. 11-4554 and 11-4571.

(AP) ? A department store Santa Claus who died with his wife and three grandchildren in a Christmas morning house fire in Connecticut spent a long career trying to prevent danger as safety chief at a liquor company in Kentucky.

A day after fire engulfed his daughter's upscale house in Stamford, Lomer Johnson was remembered fondly as a stickler for safety by a former boss at Louisville, Ky.-based liquor maker Brown-Forman Corp., where Johnson retired from his job as safety and security director several years ago.

"He spent his career trying to keep others safe," retired Brown-Forman executive Robert Holmes Jr. said Monday in a telephone interview. "And the irony is that he dies in a fire."

The home's owner, New York advertising executive Madonna Badger, and a male acquaintance escaped the blaze, which killed her parents, who were visiting for the holidays, and her three daughters, a 10-year-old and 7-year-old twins, police said.

The severely damaged $1.7 million house was torn down after the buildings department determined it was unsafe and ordered it razed, local fire Chief Antonio Conte said.

Neighbors said they awoke shortly before 5 o'clock Christmas morning to the sound of screaming and rushed outside to help but could do nothing as flames devoured the large, turreted home.

The acquaintance who escaped the fire with Badger was a contractor working on the home, police said. He was identified by the Stamford Advocate newspaper as Michael Borcina.

Interviews with them would be finished Monday, Conte said. He had no details on the investigation, and no information about the cause of the fire was released.

Johnson most recently worked as a Santa this year at the flagship store of Saks Fifth Avenue in Manhattan, a store spokeswoman said.

"Mr. Johnson was Saks Fifth Avenue's beloved Santa, and we are heartbroken about this terrible tragedy," spokeswoman Julia Bently said in a statement.

Holmes, who worked with Johnson for more than a decade at Brown-Forman, remembered his co-worker as a big man with white hair and a commanding presence.

"He was a man of not a lot of words, but when Lomer spoke or gave his opinion, it was always well thought out," Holmes said.

He said he was a bit surprised that the longtime security chief had become a department store Santa but added, "I could see Lomer doing something like that because Lomer had a passion for people."

During Johnson's long career with Brown-Forman, whose many brands include Jack Daniel's Tennessee Whiskey and Southern Comfort, he was responsible for security and safety at the company's headquarters and production plants. His responsibilities included helping plan fire drills, Holmes said.

"He spent his life as a safety professional making sure our facilities were safe from fire," Holmes said. "And in the event there was a fire, that people knew what to do in terms of getting out of the buildings."

Badger, an ad executive in the fashion industry, is the founder of New York-based Badger & Winters Group. She was treated at a hospital and was discharged by Sunday evening, a hospital supervisor said. Her whereabouts Monday were unknown.

The contractor also was hospitalized, but his condition wasn't released.

Property records show Badger bought the five-bedroom, waterfront home for $1.7 million last year. The house was situated in Shippan Point, a wealthy neighborhood that juts into Long Island Sound.

The lot where the house stood was covered with charred debris and cordoned off by police with tape on Monday. Passers-by left floral bouquets, stuffed animals and candles.

Neighbor Tim Abbazia, who did not know the victims, said the fire occurred in a neighborhood where century-old homes are common and would make everyone assess fire safety. He said it could not have been any more tragic.

"Regardless of which day it happened, I don't think it could be any worse than it is," he said.

Gov. Dannel P. Malloy, a former mayor of Stamford, offered his condolences to Badger and her family in a statement and said her loss "defies explanation."

The fire was Stamford's deadliest since a 1987 blaze that also killed five people, Conte said.

(AP) ? Hot dogs, cotton candy, hot chocolate and water. The Bengals offered refreshments Monday to fans who lined up for a ticket promotion aimed at filling Paul Brown Stadium for the final game.

The Bengals made a buy-one, get-one-free offer to season ticket holders for the final regular season game Sunday. Cincinnati (9-6) would clinch a wild card playoff berth by beating the Baltimore Ravens (11-4).

The challenge is to fill the 65,500-seat stadium, which has been one-third empty for most games this season. The Bengals have sold out only one home game, when Pittsburgh brought thousands of fans.

Cincinnati sold 41,273 tickets for its victory over Arizona on Saturday that gave the Bengals only their third winning record in the last 21 years. Fans are upset over the franchise's dismal showing and ownership's reluctance to change.

The team sold a "couple thousand" tickets Monday morning, said Jeff Berding, the team's director of ticket sales.

"We have a lot of tickets to sell," Berding said. "The response has been great."

If the team doesn't sell out with this promotion restricted to season ticket holders, it will consider a discount offer to the public.

After Saturday's win, Bengals players practically begged fans to fill the stadium for the final game.

"We had a very enthusiastic stadium last week," coach Marvin Lewis said Monday. "I tell these guys, 'I can't wait to see us play.' I think people that haven't seen us play in person will have a good time. We'll do some incredible things. We'll do some things I wish we didn't quite do, I'll tell you that. But we'll do some incredible things. It will be a good football game."

Lousy FedEx Delivery Guys: 'Conan' Uncovers More Shocking Footage (VIDEO)

Earlier this week, a hidden-camera video of a FedEx delivery man throwing a computer monitor over a YouTuber's fence went viral after getting passed around on sites like Reddit due to a striking resemblance to the opening scene in "Ace Ventura: Pet Detective."

The footage has turned into a PR nightmare for the company, and already received the "Top Ten" treatment from David Letterman, but things are about to get even messier. Upon performing a simple YouTube search, Conan O'Brien found even more totally-real, definitely-not-fake videos of FedEx delivery guys doing some pretty weird things with people's packages.

Just watch the video above and you'll see what we mean.

Oh man oh man oh man, a wild west roleplay. Pfauxmeh, you have answered my prayers.

I would love to play the navigator. May I? It's going to be amazing. I will write up my character and submit him at once, for he has just sprung fully-formed into being.

A couple questions that may affect backstory or his particular details:
Where/when do we begin? Is she recruiting when we begin, or do we have our team and are ready to set out?
Could you give a specific year this takes place, or are we going with generic wild west movie era?

I have a lovely gunslinger that could be used as a protection character, if you'll have her. She's made for a more fantasy setting but its all too easy to take that away and make her into something realistic. I adore Wild West settings and this looks so promising.

Well, it's been a while since I've been involved in a western that didn't flounder within the first tens of posts... Besides, I need a change of scenery, and this legitimately looks interesting, and the song hooked me.

That being said, I'm probably going to end up as one of the "Protection" fellows, if by protection you mean the Clint Eastwood style badass cowboys. Note, I may or may not being playing that type, just using it as an example. Also~ What is a "Helper" exactly?

Well, I submitted Jeremy Fuller for your approval. He may need a little convincing since he really doesn't take women seriously, but he'll be sorely tempted by the challenge, and you won't find a better navigator in Jerome.

Aaaaand... it's not till I typed that that I realized his name's pretty similar to the town. Oh well.

I am still interested to know the specific year we'll be playing in, 'cause it will affect whether or not he can quote Pirates of Penzance, or how famous Charles Darwin has become, or if he's been published at all. (Edit: Just looked it up, and Jerome wasn't even a town until 1883, and between then and 1903 it became "the wickedest town in the West"! Thank you, Wikipedia!)

Like, seriously. It's been forever since I've tried to preacher angle (Paladins on the other hand...) and the lady bit is because.. Well, I've found myself using a lot of lady characters lately... I have no idea why...

Yeah, I can totally see it now! Right in the middle of the potential lecture, Preacher lady would potentially shove a gun into Jeremy's face, recite a badass bible verse followed by a potentially epic quip (Preferably one about the "intelligent design" of lecturing an armed woman), and pull the trigger and reveal that that chamber was empty. Potentially.

Well, there sure is a lot of potential here if I say so myself.

That being said, if I do go for the badass preacher trope, I will have a reasonable backstory and some characterization thrown in the mix. Being rough like that for only the sake of mere badassry isn't isn't cool, need's some reasons as to why. I'm seeing her being a bandit, something bad happens, finds God, and has trouble adjusting to a pious life. Yes, yes, I can work with this.

If Pfauxmeh can work with two female protectors... I am still unsure about her being female... Eh, I'll sleep on it, see how other characters turn out.

Russia's Medvedev tries to appease protesters (Reuters)

MOSCOW (Reuters) ? President Dmitry Medvedev called on Thursday for comprehensive reform of Russia's political system to try to appease protesters staging the biggest demonstrations since Vladimir Putin rose to power 12 years ago.

In his last state of the nation address to parliament as president, Medvedev outlined plans that would ease the Kremlin's tight grip on power, including restoring the election of regional governors and allowing half the seats in the State Duma lower house of parliament to be directly elected in the regions.

His opponents, preparing for new protests across Russia on Saturday, dismissed his offer as the empty promises of a lame-duck president who is stepping aside for Putin to return to the main seat of power next year after four years as premier.

"Today, at a new stage in the development of our state, supporting the initiative proposed by our prime minister, Vladimir Vladimirovich Putin, I propose a comprehensive reform of our political system," Medvedev told rows of deputies in an hour-long speech which was greeted by occasional applause.

"I want to say that I hear those who talk about the need for change, and understand them. We need to give all active citizens the legal chance to participate in political life."

The moves were intended to address calls for change by tens of thousands of protesters who have taken to the streets since a December 4 election which they say was rigged, but Medvedev and Putin have ignored their main demand - to rerun the poll.

An aide said the proposals would be sent to parliament in the next few days.

But the opposition dismissed them as more empty words by a man who had failed to carry out his promises since he was ushered into the presidency by Putin in 2008 because the constitution barred his mentor from a third successive term.

"It's an answer to the protests, but it's not enough. It's half-hearted," said Vladimir Ryzhkov, who took part in a big protest on December 10 at Moscow's Bolotnaya Square and is helping plan another rally on Saturday at the capital's Sakharov Avenue.

"The main demand at Bolotnaya was to scrap the election results and call for new elections to be conducted according to new rules. Instead, he is trying to preserve the illegitimate Duma. This will not be accepted by society and will not be accepted by those on Sakharov Avenue."

NO WAY TO GET TOOTHPASTE BACK IN THE TUBE

Medvedev, 46, had already called for an overhaul of the political system at a meeting with his United Russia party on Saturday but provided few details of his plans.

Putin said last week that he was ready to consider allowing the election of regional governors, provided their candidacy was approved by the Kremlin. The former KGB spy had abolished the direct election of regional governors in 2004 to tighten his control of Russia's often independent-minded regions.

In his speech in a gilded Kremlin hall to members of the Duma and the Federation Council upper chamber, Medvedev said there should be a simpler process for registering parties - allowing more parties to take part.

He also proposed scrapping the requirement to gather signatures to participate in elections to the Duma and regional legislative organs, and suggested reducing the number of signatures required to run for president.

Medvedev called for the creation of an independent "public" television channel. Putin has closely controlled state television and Russian media have been criticized for all but ignoring the mass protests against his rule.

The protesters, many of them young professionals who have answered calls to protests on social network sites, say Medvedev and Putin, 59, are out of touch and cannot get away with just tinkering with a political system the prime minister dominates.

"All this was necessary to legitimize the results of the December 4 election and the coming presidential election ... It is an intentional lie and it is misguiding," said independent political analyst Sergei Belkovsky.

Comparing the proposals to the "perestroika" reforms that failed to save the Soviet Union, he said "you cannot get toothpaste back in the tube ... The system is decomposing. They are frantically trying to find ways to preserve it, but these chaotic measures just bring it closer to the end."

Best Kid-friendly Upscale Restaurants in Oceanside, California

Oceanside has so many restaurants that you could easily go to a different one nearly every night of the year, but if you have a family it is best to know where you can all enjoy a meal together and which are the best restaurants to go to.

Ruby?s Diner on Oceanside Pier may not sound very up-scale but it is one of the top-rated restaurants in Oceanside with 5 gold stars.

It is a lively "pseudo-50s" diner and is great fun for the kids. The food is excellent and comprises of burgers and fast food. But these are not ordinary burgers, the Cobb Burger (pictured) is definately an upmarket burger with bacon, bleu cheese, avacado slices and more. They also serve an alternative to chips,? garlic chips with lashings of garlic.

If you go there for breakfast you can have a Great California Benedict Waffle and as Ruby?s Diner is at the end of the pier which you have to walk along to reach getting there is an adventure in itself. If you are lucky you may see a pod of dolphins swimming by as you enjoy your meal.

There is a great atmosphere and friendly staff and many families go there, several of them have made it their home away from home.

Early in the morning you can get traditional favorites such as sausage and eggs or biscuits and gravy. For lunch they serve hot meatloaf sandwiches or patty melts but it is at dinner time the restaurant goes upscale.

A kid-friendly restaurant they serve dishes like pork chops and top sirloin which come with vegetables, potatoes and a dinner roll. They also serve delicious desserts.

Villarreal fires coach Garrido after cup exit

VILLARREAL, Spain (AP) -Villarreal fired coach Juan Carlos Garrido following the struggling Spanish club's embarrassing Copa del Rey loss to a third-tier team on Wednesday.

Villarreal exited the fourth round of the domestic cup competition after Wednesday's 2-0 home defeat to Mirandes, the final straw for Garrido after Villarreal was also eliminated from the Champions League after losing all six of its group games.

Garrido was quoted as saying he expected president Fernando Roig to make the change following the result at El Madrigal stadium.

"The Villarreal president came to me and informed me of my termination, and I extended my hand and told him I understood," Garrido said, according to Spanish media.

Villarreal, which is 17th in the league and out of the relegation zone on goal difference, said Garrido's successor had yet to be decided.

A rash of injuries, including to international strikers Giuseppe Rossi and Nilmar Garrido, have hurt Villarreal's season, while the exit of Spain international Santi Cazorla to Malaga also hurt the team.

Roig was at first ready to extend Garrido some slack but Wednesday's result saw his the former Villarreal B coach's time in charge of the first team end after he replaced Ernesto Valverde 20 games into the 2009-10 season.

The 42-year-old Garrido, who leaves after completing nearly two full seasons with the club and his first topflight coaching job, guided the "Yellow Submarine" to seventh and fourth-place finishes over the past two seasons.

"I understand the decision because the team has been a disaster and a disgrace and it's unacceptable to go out this way," Garrido said. "The coach is always the responsible one. Since the start it's been a difficult season and we paid for that over the course of the campaign."

Negative ads mix with holiday cheer in Iowa (AP)

DAVENPORT, Iowa ? Iowa residents flipping their TV channels this season aren't finding a whole lot of Christmas cheer. A barrage of negative campaign ads is flooding the airwaves, with ghoulish images of Newt Gingrich and Nancy Pelosi crowding Santa and doomsday music drowning out holiday song.

Mitt Romney is likened to "big-government liberals." Gingrich is castigated for his "baggage." The still-volatile Republican presidential field means Iowans have two more weeks of this before the leadoff caucuses Jan. 3.

The onslaught of scalding ads and messages landing in voters' mailboxes, prompted in part by a Supreme Court decision last year that helped open the floodgates, has made the race for the 2012 GOP nomination among the most negative the state has ever seen. The campaign air war, slow to start at first, has intensified as the caucuses loom closer ? leaving observers to puzzle over its recent dark turn.

"The ads are more negative than they were in 2007," said Dianne Bystrom, a political communications professor at Iowa State University.

"In part it's the mood of the country, which has certainly darkened in the last 4 years," Bystrom said. "Some of the Republicans haven't spent a lot of time in the state, so they're communicating on television. And there's lots of third party ads this time that have really changed the dynamic."

That means Texas Gov. Rick Perry is slamming Romney, the former Massachusetts governor, for supporting an individual health care mandate that formed the basis of President Barack Obama's health care law. Ron Paul is complaining about "smooth-talking politicians" over video images of Gingrich, Romney and Obama. And a pro-Romney independent group, Restore Our Future, has unleashed a multimillion-dollar assault on Gingrich, effectively doing the former Massachusetts governor's dirty work while letting him float safely above the fray.

"Newt Gingrich has more baggage than the airlines," the group's new ad says, showing Gingrich pairing with Pelosi, the House Democratic leader, to fight climate change.

While attack ads are often effective, they can muddy the instigator as much as they wound the target. That's particularly true in a multicandidate field, where an attack on one candidate from another can actually benefit a third.

Such was the case in 2004, when Democrats Howard Dean and Dick Gephardt battled each other hard in Iowa. Another rival, John Kerry, took advantage of the fray and went on to win the caucuses that year.

As an officially independent group, Restore Our Future bears no mention of Romney's name ? protecting him to some degree from blowback. It is made up of former Romney advisers.

Gingrich, for his part, isn't ready to give Romney a pass. He addressed the risk to Romney at a campaign events in Iowa this week when asked about the impact of the group's ads.

"It reflects badly on other Republicans that they haven't got anything positive to say for themselves and they have to rely on their consultants trying to tear down a fellow Republican and they are in effect doing Barack Obama's work," Gingrich said Monday. "I think the average Republican's going to be very unhappy with Republicans whose entire campaign is negative."

He turned up the heat Tuesday.

"Understand, these are his people running his ads, doing his dirty work while he pretends to be above it," Gingrich said in Ottumwa, Iowa. "I don't object to being outspent. I object to lies. I object to negative smear campaigns."

Earlier Tuesday, Romney said in an appearance on MSNBC that super PACs have been "a disaster." But he refused to urge the group Restore Our Future to halt the attacks on Gingrich, saying that the law prohibits his campaign and such groups to coordinate.

"I'm not allowed to communicate with a super PAC in any way, shape or form," Romney said. "If we coordinate in any way whatsoever, we go to the big house."

A fired-up Gingrich, who has seen his candidacy slide amid a barrage of attack ads, read Romney's remarks to reporters and then promptly labeled them "baloney." He again urged Romney to demand that the negative spots be taken down.

"I think these guys hire consultants who get drunk, sit around and write stupid ads," Gingrich said. "Every one of these candidates should take responsibility for the lies they are putting up".

To be sure, not every candidate is blistering the airwaves.

Gingrich, for his part, is trying to make good on a campaign promise to stay positive in ads even though he's swiped indirectly at Romney. The former House speaker and his wife, Callista, are expected to appear in a campaign Christmas commercial in Iowa later this week.

Cash-strapped hopefuls Michele Bachmann and Rick Santorum are focusing their limited resources on retail campaigning. Jon Huntsman has avoided Iowa in order to go all out n New Hampshire, which hosts the nation's first primary Jan. 10. Our Destiny, a super PAC supporting the former Utah governor, has run positive ads there for him.

By far the biggest jolt to the advertising landscape this time is the emergence of super PACs ? independent groups that can raise and spend unlimited money to support or attack a candidate.

Last year's landmark Supreme Court ruling easing campaign spending restrictions on corporations has brought forth a proliferation of such groups in Iowa. Restore Our Future, a super PAC, has been by far the most prolific, devoting its resources to painting Gingrich as a greedy, unethical hypocrite.

Make Us Great Again, a super PAC backing Perry, has also spent heavily on ads. Groups supporting Gingrich and Santorum have just started to go on the air.

Marty Kaplan, a political communications expert at the University of Southern California, said the negative attacks from both candidates and outside groups would all but certainly continue past Iowa.

"Negative ads work," Kaplan said. "They are compelling narratives with villains and twists that evoke emotion, and they do everything that Hollywood wants to happen to an audience."

Apple Reportedly Finalizes Deal With Flash Memory Company Anobit

anobitIt seemed last week like Apple was eyeing up flash memory technology company Anobit for a potential purchase, and now word from Israeli news outlet Calcalist is that the multi-million dollar deal has been finalized. While Anobit has already broken the news to their employees, many of the deal's salient details are still unknown to outsiders. There's still no word on exactly how much Apple paid in the acquisition aside from the vague "400 to 500 million" price tag mentioned last week, and 9to5mac's sources mention that Anobit's executive team haven't yet been formally introduced to Apple employees.

Android takes developers to school with new courses (Appolicious)

Google continues to fight off Microsoft on a few different fronts, the most recent being an all-out Android bash session where Microsoft rewarded the ?most compelling? tale of Android woes with a brand new Windows Phone device. Microsoft?s been after Android developers for several months, and is now making a direct play for consumers, too. But two can play at that game. Google launched an Android Training program for developers, helping them to create apps designed around the Android platform. So far it has about 11 general sections, with a total of 34 lessons to get you going. It?s an important step for Android to show it?s a resource to developers, especially with a promising new Android version having just hit shelves.

?From designing effective navigation, to managing audio playback, to optimizing battery life, these classes are designed to demonstrate best practices for solving common Android development problems,? writes Retro Meier, Android Developer Relations Tech Lead. ?We?re starting small and this is just the beginning for Android Training. Is Google making its own Siri?

Another project Google may be working on is a Siri competitor for Android. Android fans won?t be truly happy until it has a deeply integrated personal assistant function akin to the iPhone 4S?s Siri, and it?s quite likely Android will eventually incorporate such a feature, given its existing commitment to speech recognition and ability to leverage its own expanse of data towards a rather useful artificial intelligence program. Rumored to be code-named ?Majel,? the Siri-like initiative is said to work as well ?or better than Siri.? The story?s been gaining traction throughout the week as anonymous tipsters reveal more details of the Majel project, indicating that Google may very well see value in tying together things like Maps, Search, Places and Google Plus apps for a personal assistant tool.

Another development is the Facebook update for Timelines. The new profile feature that aggregates your life?s milestones is now available for Android users, delivering a beautified interface designed for your phone. The Timeline features a cover photo, map thumbnails and the ability to swipe through albums without leaving the screen, which is a very nice touch. And for once, Facebook updated its Android app before pushing an iOS update.

DETROIT (WWJ) ? Wayne County Executive Robert Ficano?s request to extend a contract with an outside law firm dealing with federal subpoenas has been turned down by county commissioners.

The county commissioners voted unanimously to reject the $350,000 contract. The law firm reduced the contract to $150,000, but the county commissioners still said no.

Attorney Thomas Cranmer began helping the county with the FBI ?subpoenas since they were served on eight county departments in October.

?I suspect and anticipate that there will be additional subpoenas that come forth in the days to come,? and Cranmer. ?I think it?s fair to say that ? I?d like to think, anyway, that I?ve had a good working relationship with corporation council?s office, in terms of helping them through the process.?

?They have certainly devoted a substantial amount of their own time and effort,? he said.

Ficano earlier this week asked commissioners for more taxpayer money to fund a criminal defense attorney to help comply with eight federal subpoenas involving the $200,000 severance paid to ex-county employee Turkia Mullin. He?wants to continue with the blue-chip Detroit firm of Miller-Canfield as it deals with the feds, who are probing alleged county corruption.

Commissioner Laura Cox voted no.

?This is very upsetting to me and, representing the tax payers, I don?t know how I can say, yeah, here?s a check for $350 (thousand),? Cox said. ?I?m not doubting that they do a good job, but I?m thinking that somebody else could do just as well of a good job either cheaper, or we do it in house.?

A spokesperson for Ficano said he?ll regroup.

Samsung takes aim at Apple with Australian Galaxy Tab ad, credits Cupertino for its popularity

Now that the Galaxy Tab 10.1 has been cleared for sale in Australia, Samsung is taking the opportunity to publicly celebrate its courtroom victory, at Apple's expense. Exhibit A: a local newspaper ad that flatly brands Sammy's slate as "the tablet Apple tried to stop." The spot, which ran in the Sun-Herald this week, came just a few days before Samsung Australia's mobile head openly credited Cupertino for making the Galaxy Tab a "household name." Speaking to the Sydney Morning Herald, Samsung Australia's vice president of telecommunications, Tyler McGee, declined to say how much his company lost in sales revenue due to Apple's temporary injunction, but was more than willing to laud the iPad maker for inadvertently turning the spotlight on the Galaxy Tab. "At the end of the day the media awareness certainly made the Galaxy Tab 10.1 a household name compared to probably what it would've been based on the investment that we would've put into it from a marketing perspective," McGee explained. The exec went on to say that the manufacturer is bringing to market "as many units as we can," since it expects the device to be in "short supply against the demand." To the courtroom victor go to the spoils -- including, apparently, bragging rights.

User documentation

The Voodoo team has put great effort into preparing proper documentation for the end users. Please make sure to go through it as it answers several common questions.

Unfortunately currently the documentation is only available in English. We would appreciate if the community helps in translating it to other languages. We are looking for the following translations (in order of importance): Chinese, Korean, German and Russian, at the moment.

Developer documentation

Two white-papers detailing the technology that went into the kernel are being prepared and will be available soon. One of them describes the changes made in the kernel from a higher abstraction level, to enable developers to get to grips with the source tree. The second one is a highly technical paper describing the design and implementation of the vastly improved SSE3 emulator. Further documents may be available in the future.

Bug reports

Note: We have exceeded the attachments quota for Issues on Google Code. We're going to ask Google to extend it, and/or find alternative methods for you to get your system info or KP screenshots to us. Until then, please use SendSpace or Mediafire for the .tar.gz files, Pastie for pasting crash logs and ImageShack for putting KP screenshots.

Please go through the list of open bugs and if your problem is in the list, STAR it instead of posting a new report. Starring a bug report means voting for it and will push us to try fixing that first, and also helps avoid duplicate reports.

We are not accepting any more bug reports for sleep/resume problems. Incomplete reports will NOT be entertained. Please be prepared to describe what steps you have taken to fix the problem yourself. Only report an issue if you believe its a bug in the kernel. We have found that almost all bug reports for the release candidate have been because of external reasons (like kexts, not updating to 10.5.5 and so on). Once ready, go to the Issues tab.

Is it legal to distribute them? They are taken from publicly available samples on the record company websites themselves (hence the sometimes low bitrates), slightly edited/enhanced. Some tracks are also composed by mercurysquad who holds the copyright.

Five Favorite Films with Roger Corman

Movies as we know them just wouldn't be the same without Roger Corman. Sure, filmmakers like Francis Ford Coppola, Martin Scorsese, Jonathan Demme, James Cameron and Joe Dante probably would have found their way into the game eventually, but the fact remains that they all got their start under the tutelage of Corman and his low-budget genre factory -- a tireless B-picture production line that also gave early breaks to unknown young actors like Robert De Niro, Sylvester Stallone and Jack Nicholson. Perhaps more significantly, Corman was one of the pioneers of the independent movie model, cranking out scores of exploitation and genre films (and distributing foreign titles by Truffaut, Bergman, Fellini and Kurosawa) that turned profits even as they flaunted the traditional studio system. (Not to be discounted: he also directed a handful of genuinely fine movies, like the Edgar Allan Poe adaptation The Masque of the Red Death.) This week, Corman is celebrated in Alex Stapleton's documentary Corman's World: Exploits of a Hollywood Rebel, a career-spanning look at his work that gathers together exultant testimonials from many of his most famous pupils. We caught up with Corman earlier this week for a chat about his career and his "graduates," his thoughts on independent film, and how the Lucas/Spielberg blockbusters spelled doom for genre pictures. First, here are Corman's five favorite films.


Well, if I were to pick my five favorite I would probably start with Battleship Potemkin, the great Russian silent film. To me, that is the greatest film ever made. It was probably the originator of a number of cutting techniques -- the "Odessa steps" sequence, with the baby carriage rolling own the steps at the same time the troops are marching down the steps, is still one of the most powerful montage sequences I've ever seen.

If I went on to number two, there it becomes more difficult. I would say probably Lawrence of Arabia. I would say simply for the epic scope; the broad expanses and deserts, and then cutting in tight from these giant long shots to Lawrence and the other characters. And the power of Peter O'Toole's performance as Lawrence.

Citizen Kane: So many people would pick that and there isn't much I could say about it. The photography is extremely good. He was using a lot of low angles, he was using covered sets; and at that time, and still, very few art directors will put a ceiling on a set because it makes it very difficult to light, but he gave it a great feeling of realism. Also, it was a brilliant script. It's well directed, well acted -- Welles himself is brilliant as Kane -- and it really stems from the script.

Did you ever meet Orson Welles?

Yes, I did meet Orson Welles. Orson and Peter Bogdanovich and I had dinner one night, and I met him a few other times. When I did The St. Valentine's Massacre at Fox I wanted classical actors for Al Capone, the leader of the South Side gang, and Bugs Moran, the leader of the North Side gang. We cast Jason Robards for Bugs Moran and I wanted Orson Welles for Al Capone. The executives at the studio said they agreed with Jason, but they said, "Roger" -- and I was fairly young at the time -- "this is your first picture for a major studio, we have to tell you nobody can work with Orson Welles. He takes over the set and does anything he wants." I told the story to Orson and Orson said, "[I'm] probably the most cooperative actor anybody ever saw! I don"t know what they're talking about. I would have been great as Capone!" [laughs]

Then each one becomes more difficult as I go along. On the Waterfront -- you go straight to Marlon Brando. It was a good picture all around, a good script, and Kazan directed it brilliantly. And the shooting on location, I would assume they would have never shot in a studio -- the look of the film gives a great sense of realism, that you are there on the waterfront, you're there in cold weather, you can see the breath coming out of the actors mouths. I would say it's probably -- probably -- Marlon's best performance, although you would have to give a nod to Godfather.

Avatar (James Cameron, 2009; 83% Tomatometer)

You know, I would pick Jim Cameron's picture, Avatar, as a fifth. It's the only new picture, I think, that can be up there in that group. Jim Cameron, one of our graduates -- who started making low-budget science fiction pictures for us -- went and jumped ahead and here's Avatar, the most expensive science fiction picture ever made. Jim's a technical genius, and the fact that he single-handedly brought back 3D -- which had been up there, in and out a few times; in the '50s and then forgotten -- and he used it beautifully and sensitively. So many times when a director's working with 3D you have the shot of the arrow coming out of the screen, shooting straight at the audience, and effects like that; he deliberately stayed away from that type of effect and just showed you the 3D world. And the use of computer graphics, green screen, motion capture and so forth for the blue-skinned people on the planet -- I just thought it all came together as a brilliant film, both technically, in the way he used 3D, and in the beauty of the picture itself.

Speaking of your graduates using 3D -- have you had a chance to see Martin Scorsese's Hugo yet?

Yes, I saw Hugo and I was very impressed with it. Again, Marty used 3D sensitively and intelligently, and once more he was restrained in the use of 3D. You had a few things coming out toward you, but primarily you became immersed in the story, and Marty filmed a great story. The story of Georges M?li?s, the old French director and one of the originators of film, and the story the young boy I thought was beautifully down. I think it's an excellent film.

Next, Corman talks about some of his famous graduates, the state of independent film, and how the Spielberg-Lucas blockbusters spelled doom for his genre movies.
